Court throws out case to produce Aine

KAMPALA. The High Court in Kampala has thrown out an application that was intended to order the Inspector General of Police Gen. Kale Kayihura to produce the body of Christopher Aine, the former head of security of former presidential candidate Amama Mbabazi.






While dismissing the application, presiding judge Lydia Mugambe Ssali observed that no evidence had been produced before her to show that it’s the police that are holding Aine.
Aine was last seen on December 14 last year from his Kyanja residence and his family has since accused the police of picking and illegally holding their son in ungazetted place, an accusation the police has vehemently denied saying they are also looking for him over criminal and election related offenses.
The judge also held that the court can only order police to produce a missing person if court is sure that indeed the missing person is in police detention contrary to the present case where court has no evidence that Aine is in police’s hands.






“It’s not certain that the applicant (Aine) is in police custody, I have no material evidence of how exactly the applicant disappeared in December 2015 to safely conclude that he was taken by the police and that he is in police custody.” ruled justice Mugambe, adding: “Perhaps this court would have been assisted by evidence of anyone, a neighbor, mama Sarah who witnessed the applicant being taken to assist in demonstrating who took him, the application as presented cannot be allowed, its accordingly denied at least this time.”
The judge further in her ruling, said the bigger concern now is for the police and Aine’s family to trace and find him instead of trending accusations on who is holding him.
