Kiggundu to appear in court

Complaint. A petitioner wants the EC boss to explain whether the Declaration of Results forms on which his rival was declared winner of an MP seat are legal.






Arua. Electoral Commission chairperson Badru Kiggundu is expected to appear in court to testify in the election petition in which former Arua Municipality parliamentary contender Bruce Musema Mudathir is challenging the election of Mr Ibrahim Abiriga as MP.
Mr Musema wants Mr Kiggundu to explain whether the Declaration of Results forms on which the EC declared Mr Abiriga the winner were in accordance with electoral law.






His lawyers contend that EC used wrong forms to declare Mr Abiriga’s victory in order to escape prosecution because he did not have the required academic papers for an MP.
“We want Kiggundu to tell court why the Declaration of Results forms used officially by the EC are different from those presented by the first respondent (Mr Abiriga) and all those used in previous elections,” Mr Kwemara Kafuzu, a lawyer, said.
Justice John Keitirima adjourned the petition for further hearing on June 7 when Mr Kiggundu is expected to testify in court.






The judge rejected the submission by lawyers for Abiriga and EC that Mr Kiggundu was too busy to appear in court.
Mr Musema lost to Abiriga in the February 18 elections.
Meanwhile, Mr Dixon Adomati, a resident of Arua Town told Saturday Monitor that police had blocked him from filing a case of forgery against Mr Abiriga but police say they cannot because another case is still going on.
