KAMPALA- Fourteen suspects on remand over the failed attack on Kabamba Barracks in Mubende District have asked the military court to release them on bail pending trial.
The group through their lawyers led by Mr Frederick Semwanga told the General Court Martial at Makindye to allow them make formal submissions and present sureties to stand for them.
“…This case has taken long without trial. The state has brought only two witnesses in two years which is unfair. We pray for a short adjournment of one week to allow us make formal application and present sureties and should prosecution fail to bring witnesses, let court direct them to close its case,” said Mr Semwanga in response to the State submission for adjournment.
Prosecutor Maj Raphael Mugisha told court they needed more time to call the witnesses to appear in court. The group has been on remand since 2014 over offences related to the alleged botched attack on Kabamba Army Barracks.
Those charged are Lt Col Philip Eguma, Capt Bosco Aleper, formerly of the Armoured Warfare Training School in Mubende, Lt Ronald Mwavu, a junior officer formerly from the 4th Division, Pte Kenneth Sekajja, formerly of Air Defence in Nakasongola and Sgt Ndugga Musaazi.
Others are Mr Marvin Mulongo, Mr Nasim Namuzimule, Rtd Capt John Bosco Rutwama, Mr Ali Mukiibi, a retired air force pilot, Mr Francis Kiwanuka, Herbert Biyimbwa (herbalist), Peter Kibirige (electrician), Patrick Kibuuka (casual worker) and businessmen Solomon Matovu, Francis Kaheru, and Lumala Salongo.
The accusations
The State alleges that between February and May 2014, in various areas of Kampala, Masaka, Wakiso, Luweero and Nairobi-Kenya, Lt Col Eguma, Capt Aleper, Lt Waibi, Pte Sekajja and others, omitted to disclose vital information about recruitment of people to engage into activities intended to prejudice the security of the defence forces by attacking Armoured Warfare Training School in Mubende.
They appeared before the Military Court chaired by Lt Gen Andrew Gutti for hearing of the case but it was adjourned to August 9 this year to allow the State summon witnesses.
Gen Gutti asked the accused persons to present their arguments for bail on the same day.
